Real Property

If you or your spouse owned property prior to marriage that was brought into the marriage, it's possible there could be competing interests between "the community" and each individual spouse. We'll analyze the chain-of-title, and any other relevant extrinsic documents, to establish the property's characterization. We'll analyze the mortgage payment history and obtain appraisals for the relevant points in time to calculate each individual spouse's interest (if any) and the community's interest.

Pensions

Many clients or their spouses have a pension, which is often the second most valuable asset in the estate after the marital residence. Lustig Law will join the employee-benefit plan of you and/or your spouse's pension to the lawsuit as soon as possible to protect your interest and freeze the account. 


Once the divorce is over, whether by agreement or by trial, we'll prepare the Qualified Domestic Relations Order dividing the pension and work with you through the process until the pension has been actually divided and you received your share of the funds.

Analizaremos la cadena de títulos, y cualquier otro documento extrínseco relevante, para establecer la caracterización de la propiedad. Analizaremos el historial de pagos de la hipoteca y obtendremos tasaciones de los puntos relevantes en el tiempo para calcular el interés de cada cónyuge individual (si corresponde) y el interés de la comunidad.
